Who you are dealing with

This website is published by OPERIYA, an AI operations and automation consultancy operated by Bipasha Das, Founder & CEO, from India. In these terms “we” and “OPERIYA” mean that business, and “you” means anyone using the site. Contact is hello@operiya.com.

Using the site means you accept these terms. If you do not, the remedy is to stop using it.

What is on this site is information, not an offer

The pages here describe a method, a way of working and the stages of an engagement. None of it is an offer capable of acceptance, and nothing on the site forms a contract by itself. Nothing here is legal, financial, tax or accounting advice, and it should not be relied on as a substitute for advice about your own circumstances.

Fees and quotations

No fees are published on this site. Every engagement is quoted individually, in writing, after the introductory call, because the number depends on scope — how many departments are involved, how much access is available, and how much of the process is already documented.

• A quotation states a fixed fee, what is included, what is excluded, and the dates. It is not an hourly rate.
• A quotation is an invitation to proceed, not a binding contract. Work begins when the engagement agreement is signed.
• The introductory call is free and carries no obligation to request a quotation, and a quotation carries no obligation to accept it.
• Quotations are valid for the period stated on them, and are withdrawn or re-quoted if the scope changes after issue.

The guarantee

The site states that if the audit does not find at least $50,000 in recoverable annual waste, you get a full refund, subject to one condition: honest access to the people doing the work and the numbers behind it.

That is an accurate summary of the commitment, but the binding version — how the figure is measured, what counts as access, how and when a refund is claimed and paid — is set out in the engagement agreement. Where this page and that agreement differ, the agreement governs. The guarantee applies to the audit stage and not to implementation or retainer work.

Engagements are governed by a separate agreement

Before any paid work starts, there is a written engagement agreement covering scope, fees, timelines, confidentiality, data handling, ownership of what gets built and how either side ends the arrangement. That agreement, not this page, is the contract. If anything in these website terms conflicts with it, the engagement agreement wins.

Intellectual property

The content of this site — text, structure, diagrams, the OPERIYA name and mark, and the design system behind it — belongs to OPERIYA. You may read it, quote it with attribution, and link to it. You may not republish it as your own, or reproduce the brand elements as part of another business.

Work produced during an engagement is a different matter and is dealt with in the engagement agreement. The site’s position, which that agreement reflects, is that the client keeps what is built: the process map, the Business Brain repository, the automations, and the documentation, running in the client’s own accounts.

Links to other sites

This site links out to a small number of third parties — the booking page, a LinkedIn profile, the notices of our host and scheduling provider. We do not control those sites and are not responsible for their content or their handling of your data. Their own terms and privacy notices apply once you are there.

Availability

We try to keep the site up and accurate, but it is provided as it is. We do not promise uninterrupted availability, and we may change, move or remove any part of it without notice. Content is accurate at the date shown at the top of this page and is not continuously revised.

Liability

To the fullest extent the law allows, OPERIYA is not liable for loss arising from your use of, or inability to use, this website — including lost profit, lost business or lost data. Nothing in these terms limits liability for fraud, for fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Liability arising from an engagement is dealt with in the engagement agreement.

Acceptable use

Do not use this site unlawfully, attempt to gain unauthorised access to it, interfere with its operation, or scrape it at a volume that degrades it for anyone else.

Governing law

These terms, and any dispute arising from them or from the use of this site, are governed by the laws of India, and the courts of India have jurisdiction over them.

Changes to these terms

These terms may be updated as the site changes. The version in force is the one published here, dated at the top of the page. Changes are not applied retrospectively to an engagement agreement already signed.
